All that glitters is not gold says a former tenant of an upscale property, The Barcelona Lofts in San Antonio Texas. As always, due to privacy, we do not disclose the name of the tenant. However, we have pictures to show the type of deep rooted infestation the tenant was dealing with, and they are quite disturbing. Also, images of the mold damage. The tenant alleges that the unbeknownst to her, the mold had been in the apartment since a February 2014 flood in her apartment in at the upscale property.

“When my apartment flooded around 6:30 pm, after multiple calls, no one came out to check on me. I had to finally call the fire department who responded quickly, wading through the water to unplug all of the electrics. They even tried to wait with me until the property manager or maintenance showed but they did not, and the fire department finally receive another call and had to leave.” She says maintenance finally showed up a one in the morning after driving in from Austin. While he sucked up the water with a vac and left a humidifier in the apartment, lots of water was left standing. It was days later that I had to urge them to come and take care of their cabinetry which was badly damaged in the flood which was caused by a faulty pipe, and was no fault of her own.

IATD drafted the docs to assist with the tenants filing of a Pro Se case for Remedy and Repair. The matter was settled today when the apartment manager proposed a suitable settlement. The tenant was allowed to move without any broken lease attachments to her record, and a full forgiveness of April’s rent, along with a protracted move out date for May verses October 2015.

A separate suit for Constructive Eviction is currently underway.
