Doordash has been accused by multiple consumers of failing to inform them of canceled orders and also to refund canceled orders, pre-tipping disclosure which exposes customers to hostile drivers, unjust enrichment and other flagrant violations under the Deceptive Trade Practices laws. Also at issue, Doordash routinely partially refunds orders and withholds nearly a ballooned 18% service fee in addition to prepaid tips.

Doordash’s ‘pre tipping’ policy encourages food tampering. Specifically, drivers have been accused of tampering with orders in cases where customers opted not to include a tip in the already inflated business model. Tipping is designed to be paid after a service is received. Yet, drivers are biased knowing beforehand if they received a tip. A number of customers believe this is why their orders are cancelled, delayed because the incentive to provide good service is removed, or their food orders are tampered with.

One customer placed an out of state order on Mother’s day, May 12th 2019. Since she was out of town and wasn’t able to actually take her mother to dinner, she figured she would at least be able to treat her to dinner using the Doordash service. So, she excitedly told her mom about doordash and placed the order. The mother waited for hours for the meal which never came. Upon further research and an online complaint via Doordash’s website, she received no response. She followed up with the complaint and request for a refund days later by phone and was told that she would receive a refund and to give it seven to ten days. On May 23, the customer reached out to Doordash again email complaining to them and stating that it was her final time requesting her refund from the company who is being unjustly enriched by willfully, and unlawfully failing to refund its customers.

When an order is cancelled by Doordash, consumers are entitled to both a timely notification of the cancellation as well as a full refund of all of their monies including delivery fees. Moreover, they are entitled to equitable recompense.

Because they routinely fail to respond properly or refund or actually provide credit for failing to provide their advertised service, consumers are due to be compensated.

Food tampering is a felony in some states, yet Doordash contributes to the problem. A customer ordered from a BJ’s Restaurant and recalls reducing the pre-selected tip to $3 versed the highlighted, $6. When her order arrived, she was unable to consume her drink which smelled like a combination of urine and soda. Her complaint to Doordash, again was met with no response.

Doordash must be held accountable for their false advertising, deceptive trade/business practices and nearly mandatory pre-selected tipping patterns, or at the very least, for disclosing to their drivers what their tip is ahead of deliveries. All of these ingredients makes this issue ripe for a class action suit as it is reasonable to believe that all of these reviews an complains IATD has heard from are based on truthful experiences.

This office has alerted the Texas Attorney General, Greg Abbot of our concerns also.
