The Tax Reform Act of 1986, the LIHTC program gives State and local LIHTC allocating agencies the equivalent of nearly $8 billion in annual budget authority to issue tax credits for the acquisition, rehabilitation, or new construction of rental housing targeted to lower-income households. What good is providing eligible families this benefit if you are going to expose them to predatory towing schemes that also target the very neighborhood supposedly designed to allow them to live decently and ultimate thrive?

Recently, on May 14th, 2017, a single parent was fired off of her job due to an unscrupulous towing company refusing to grant her a timely appointment to retrieve her only vehicle. This same company refused to provide her a receipt, and also overcharged her according to the new city ordinance in capping the previous excessive towing and storage fees.

The company in question, Cole Towing & Recovery out or Welford, SC also has a history of being charged with illegal towing coupled with numerous complaints from residents from a string of low-income families consisting of seniors, the disabled veterans of fixed income and single parents working for minimum wage. Cole was charged with 25 counts of miscellaneous criminal offense illegally towing vehicle Greenville County Ordinance 4278.

He was also charged with eight counts of blackmail or extortion, five counts of grand larceny value more than $2,000 but less than $10,000, one count of criminal conspiracy and one count of pointing and presenting a firearm at a person. The company also has undergone a name change.

Residents have become so desperate that they formed a tenant association, garnered 99 percent of the signatures from other residents, as well as implemented a ‘night watch’ in order to knock on doors and surrounding vehicles to prevent these towers that appear like thieves in the night and take vehicles to avoid an audience. The elderly and disabled should not be relegated to sleep deprivation in order to counteract the economic damage to their fellow neighbors.

Tenants also spoke at the County Council meeting on Jul 17th, 2017 that netted another emergency meeting for July 27th 2017 due to the overwhelming evidence and experience these, mostly elderly women and disable tenants were subjected to including being referred to a ‘monkeys’ as this property along with six others being devoured by Cole’s money grubbing antics are predominately black residents which constitutes blatant racism, as in checking, the predominately white and upscale properties are not targeted by Cole who specifically approached the black properties to carry out his dastardly deeds and spew racial slurs at the women he is preying on.

Spartanburg Sheriff Chuck Wright addressed the County Council and stated that Cole must CEASE and DESIST preying on the residents, yet Cole continues to do so, mocking the Sheriff as well as the new city fee cap.

Other victims include a young military officer who they would not allow he and his girlfriend to retrieve her car on the same night as they followed Cole’s to the lot. They damaged her vehicle, allowed it to rain in it for over a week as and refused her money in hand in order to drive the cost up. The pair was chased off of the tow yard and down Highway 29 at speeds of 95mph upwards prompting the young officer to call 911. Cops intercepted the chase and the two towing trucks claimed they were chasing him due to him threatening them with a gun. The military officer agreed to a search of his person and vehicle to disprove the false accusation. No weapon was found on him or in his vehicle. Their bill was over $800 when they finally released it.  A disabled senior who had just been released from an out of town hospital due to having a tumor removed. They towed her vehicle in front of her face refusing to drop it which sent her right back to the hospital with a stroke. They first told her it was due to her having no placard, which she pointed out, then changed it to she was parked on the handicap access lines in her handicap parking spot.  Yet another young female college student who they refused to return her car even with payment and proof of registration, citing the paperwork didn’t look right, thereby setting the ground work to tack on fees to her bill. Also, another single mother whose car was towed. Once her teenage son came home to take her to get her car, his car got towed within minutes of him being inside with her, hitting her twice to the tune of over $700 to retrieve both vehicles.

When these community members who expected to reside in a peaceful environment on these properties that qualified for both tax credits, as well as those that are similar subsidized via the Section 8 program, they had no idea they would be terrorized by individuals whose background check would prevent them the approval it takes to reside there themselves. As such, these tenants have expressed a desire to make a grand exodus from properties that employ predatory towing on the premises. These companies do not have any good intentions, except to extort monies from the working poor or, those on fixed incomes who are non-threatening given the clear records that got them into the property, who they feel are docile enough not to resist their unethical, guerrilla tactics.

While these abhorrent infractions have taken place in Spartanburg, Greenville and surrounding cities along with bordering states, research strongly indicates that this is a far-reaching injustice that impacts the poor exponentially, and more disproportional all across the country. Moreover, the knowledge that more often than not, the average family is one paycheck away from homelessness makes this issue, not only a valid one that merits your immediate attention and action, but also one that must be given your full attention and top consideration as well as the attention of lawmakers. That being said, we are approaching lawmakers to request stronger legal ramifications, with teeth regarding ordinances for suspending a towing license, as well as the ability to gain licenses. Also, in prohibiting these unscrupulous companies from simply changing their names once they lose a license by establishing steep penalties for those who withhold past illegal towing action taken against them under changed company business names. Raise towing license fees as well as tie renewals to past complaints and open or unresolved complaints and lawsuits.
